Clutch, I believe you've said it all.

If Baron Oakenshield did not wish to see Magnus as Overlord, he should have taken other measures other than taking advantage of the Test of Worthiness and his relationship with the Overlord.

The Overlord may go back on whatever he has proclaimed to the public; he obviously has the reputation amongst his many loyalists to do so, but the reason for the Test's use, in its original intent, has yet to be explained.

I hereby remain neutral on this matter, and (those have read this far may call me a hyporcite) unnoticed.

Yes, three lefts...I believe Zen is correct.

You've obviously missed my point. Being a good dueler and being a good person are two different things. You said you wanted to see him act like a good *dueler*. Ah, well, I was just poking fun anyways.

Of course, the issue is not whether or not Dalamar can change a policy. If he wanted to, he could suddenly decide to institute the test in every duel he saw fit, realign every baron Renegade if he wanted to, and intercede on every defense match for every Loyal Baron left, if he felt that was what he should do.

It's just nice to know he's planning on it, and why he's decided it-- but, actually, that's all it is. It's like someone (I forget who) wrote earlier: The Dal opponents have another weapon, the Dal supporters still haven't changed their mind. It all depends on how you view it.

A question of mine is that I have heard some Dal supporters say he can change his mind whenever he wants without explanation. Yet, I have seen examples of loyalist Barons changing to Renegade, even offering full explanation, and these same people condemn this changing, saying, ironically, "You took an oath of loyalty, what makes you think you can change your mind on it?".

Merely food for thought. Not all Dal supporters have said this, only a few.

Frankly, I think a debate over whether it's right or not will have the same results as always: Dal supporters say something, Dal opponents say something, a big argument ensues, lots of insults are flung around, and in the end nothing is learned. So far I've been wrong on this one; it's taught me something.

I know this is kind of rambling, and maybe even a bit questionable at points, but I wrote my thoughts down as I thought of them. I'm not big on editing unless I'm posting something noteworthy or official.

As a note, imagine I was overlord? Ok, it was my intention when I challenged that if I was to win, tests would never be seen, to either Warlords OR Barons. Had I actually had the chance to duel Dal, and if I had won, I would have faced each challenge to me as I did when I was a baron, by myself, with no help. as the best dueler should.

Magnus,

Reason I said dat was my intercession had nothin' ta do with yer worthiness. Everyone kept quotin' yer defenses ta prove yer worth. I didn't give a rats ass about yer worth I just didn't want ya as Overlord, simple.

However, Dalamar's worth as Overlord is constantly called inta question, it amuses me people scream and whine over an intercession or two. He's defended his station so many times alone, so many times more dan any of his nay sayers EVER will, his opposition seems ta be a big joke.

1) Dalamar Ar'Daumon is my friend
2) I don't really know Magnus at all, nor how he'd reign over DoS
3) Our current Overlord is doin' a fine job and is a winnin' example of "Supreme Dueler of DoS"

Prey tell what other measures can I take as a Baron against a Baron? I really hope a rules discussion is held soon and I can propose some rules of Baronial combat; would make loyalist and renegade even more useful of a title, but until da rules change, barons can't affect barons other dan in da "Test of Worthiness"

Maybe ya should spend a little more time here in DoS and learn da rules before ya tell me what I should and should not do.

By da way, its been done before. Feadur aligned all barons renegade, in essence preventing any duels of intercession on any occasion; so its not a novel idea.

Dear People,

Lets look at this objectively and try to remove our biased feelings from the discussion. What I feel is taking place here is the opinion that Dal has or has not broken his contract to the community. Lets examine contract law, as I understand it to exist here.

A contract is a legally binding agreement that must have certain elements which are: (a) an agreement (b) the agreement must be between competent parties (c) it must be based on the genuine assent of the parties (d) supported by consideration (e) made for a lawful objective (f) and in the form required by law, if any. Lets look at the contract that existed between Dal and Kal.

First, part (a). An agreement arises when one person, the offeror, makes an offer and the person to whom the offer is made, the offeree, accepts. There must be both an offer and an acceptance. If either is lacking, there is no contract. Since I was not privy to the talks between Dal and Kal I cannot know who was who in the dealings. What we do know is that Dal would not test barons as long as Kal was loyal. Each gave a promise
dependent on the others promise. What existed so far is called a bilateral contract.

Part (b) the agreement must be between competent parties. Do any disagree that both Dal and Kal are highly competent?

Part (c) it must be based on the genuine assent of the parties. Again, can any find reason to disagree with the parties involved?

Part (d) supported by consideration. Each parties promise to the other is consideration.

Part (e) made for a lawful objective . No laws or rules were broken.

Part (f) and in the form required by law, if any. I know of no laws here that dictate any form that a contract must take. I see no violation of this element.

The very wording of the contract that existed between Dal and Kal excludes everyone else; bilateral contract. It really concerned no one else. Do not confuse Dal's willingness to state his new policy as binding. Aside from that, Kal released Dal from the agreement. Lets review Dal's comment to the community at large.

Fellow Patrons of the Duel of Swords,

I will make this letter brief. I am herein announcing my intention to change one of the policies of testing that I have believed in during the course of my reign. From this point forward, I will not seek the aid of a champion in any challenge I receive from a duelist currently holding the rank of Baron.

I believe the key word is policies. As I have already stated the elements needed for a contract to exist, it is simple to see that none was formed with the community. What has taken place by those that feel Dal has broken his contract to the community is called promissory estoppel.

Promissory estoppel is a doctrine under which a person may make a promise to another under such circumstances that the promisor (example Dal) should reasonably foresee that the promisee (Barons and to a lesser extent the community) will be induced to rely on it and that the promisee will sustain substantial loss (i.e., be tested) if the promise is not kept.

Dal made no such promise to the community; there was no contract existing between him and the community. The only contract that existed was void long ago. Legally...legally, there has been no misjustice. Morally...I will not argue this one. I will say, however, that since the slash in taxes we have seen a flood of new blood into Rhydin, some good, some bad. The point is that there is a large number of people that desire positions and I feel the road
should not be an easy one for them. I am not implying Magnus with this statement, I am just making a general opinion.

that. What I am going to say won't win me too many friends, but you know what? I don't care.


To the Pro-Dals: The argument I am picking up from you here is that Magnus was a relative unknown who shouldn't have the right to be Overlord. And who died and gave you the right
to decide that? Magnus has defended his ring 4 times with success. Even if he hadn't, the fact he wears a Baronial ring says something about his skill. As far as his actions, I have yet to see one thing terrible or even one bit of misconduct from Magnus. And Jeff: He beat you. Quite handily. And this whole deal about not challenging barons...it dates from a promise by Dalamar to Kalamere. Why? To keep him Loyal. If Dalamar was the awesome champion
his supporters claim him to be...what would have been the reason for this deal?
He would have simply took Kalamere on and took him down. End of Challenge.

To the Anti-Dals: First off: Dalamar didn't enact the Test of Worthiness. Jeff asked for this
intercession. That isn't too hard to understand, is it? Sides, when Jeff stood in Magnus's way-by HIS choice, not Dalamar's-Magnus took the simplest route to overcoming the obstacle: He knocked it down. Second off: Kalamere released Dalamar from his vow....and even if he didn't...Dal still could have broken it...it was a vow, not a contract....it would have been totally devoid of honor, yes, but it would also be his choice. Third off: I've seen Dal
in the Arena...he doesn't come off as inappropriate for his title at all. Fourth off: Guys, Dalamar resigning or being stripped of the title..would be bad for you in the long run. Simply: He'll be able to brag that he couldn't be beaten for the Overlordship.



To both sides: Think about this....all your arguments and your rifts are based on your differing opinions of Dalamar as Overlord...and one day, he will no longer be Overlord. What then, I ask? Will you continue to hate each other?


P.S. I respect Jeff a lot...and Dalamar..and Magnus. I am just stating an opinion.
